*** CYBER-STALKING, MALICIOUS COMMUNICATIONS, ON-LINE HARASSMENT & ENDANGERMENT ADVISORY – The publication, distribution, ‘posting’ or other forms of on-line dealing in the pertinent elements of the Infringing / Violating Materials reported herein (the details of which are set-out in the notification below) are seemingly designed to encourage and incite hatred against and harassment of the Rights Owners (and related parties) and have been posted by an individual who is cyber-stalking officers of the Rights Owners. Not only do such activities violate, inter alia, United States Federal, California State, Nevada State, United Kingdom, European Union and international laws relating to cyber-stalking, malicious communications, on-line harassment, intimidation, incitement and cyber-stalking, but such activities also potentially and seemingly intentionally jeopardize the physical and emotional safety of the Rights Owners, as well as all pertinent Hollywood Access employees and related parties (such as immediate family and who, as a result of the Infringing / Violating Materials, may also suffer physical and emotional harm). As such, the Rights Owners shall hold you responsible should any harm befall them and / or all related parties as a result of the publication of the Infringing / Violating Materials complained of herein and as specified further below (or the enablement of such publication). ***
*** FAKE NEWS, MISINFORMATION, MALICIOUS FALSEHOODS & CONSUMER PROTECTION ADVISORY – For the avoidance of doubt, the deliberately bogus and ‘planted’ fake reviews – constituting fake news / misinformation / malicious falsehoods in respect of the Rights Owners (and all pertinent employees / related parties) – on the Infringing / Violating Web-Site are both false, highly misleading and highly damaging to the Rights Owners (and, again, all relevant employees / related parties). Please be further advised that these fake reviews are actually part of a personal vendetta against the Rights Owners by the relevant author of the posts / reviews in question (an individual with a history of on-line ‘trolling’) and in an attempt to deliberately mislead on-line consumers / potential customers into not engaging Hollywood Access. Not only do these deceptive and fraudulent practices go against the very purpose and principle of review sites – as well as clearly violating such sites’ Terms of Use / Acceptable Use Policies – but these practices also violate United States Federal, California State, Nevada State, United Kingdom, European Union and international consumer protection laws and laws relating to so-called ‘fake news’. Subject, simply, to the conduct of all appropriate and applicable pre-action protocols on a jurisdiction-by-jurisdiction basis, legal / remedial action shall ensue against all parties publishing such fake news / misinformation / malicious falsehoods, as well as against all parties facilitating or otherwise enabling the publication of such falsehoods (including, but not limited to, all pertinent / culpable web-site owners, all pertinent / culpable web-site administrators and all pertinent / culpable web-site ISPs and hosts). ***
*** TERMS OF SERVICE ADVISORY – We would further advise you that the Rights Owners are legally entitled to expect both the Infringing / Violating Web-Site and its pertinent ISP to uphold / enforce their own, respective, published Terms & Conditions / Acceptable Use Policies, as they are parties who may, with reasonable foresight, suffer loss and damage by reason of any failure to uphold such published Terms & Conditions / Acceptable Use Policies through the publishing – or enablement – of malicious communications or other published violations or infringements of the Rights Owners’ rights and intellectual property. ***
*** CACHE ADVISORY – Again for the absolute avoidance of doubt and by way of further guidance, this takedown notice / request relates to both A. the Infringing / Violating Materials as again defined and notified below and, equally, B. the source files and so-called ‘robots.txt’ files containing and otherwise relating to the Infringing / Violating Materials on the Infringing / Violating Web-Site’s servers (as applicable and once again as defined below). Accordingly, please ensure the removal of all relevant server-stored content and robots.txt files at the same time as the Infringing / Violating Materials are taken-down and in order to also ensure that any such server-stored content and files are not indexed / re-indexed and published by internet search engines (and, equally, so that such search engines’ listings and caches can be properly cleared of the pertinent Infringing / Violating Materials).
